Mar 08, 2022--The Ministry of Communications, Science and Technology (MCST) is currently drafting Electronic Transactions and Communications Bill, 2022.


The Bill is made pursuant to ICT Policy, 2005 to provide a legal framework for regulation of electronic communications, electronic signatures, consumer protection, limitation of liability of service providers and electronic government services as according to information received within the Ministry.


Amidst its objectives, the Bill seeks to provide equal treatment to paper-based and electronic information Provides for facilitation and regulation of electronic transactions and communications.


Moreover, it provides for protection of consumers or suppliers while also provide for regulation of e-government services as well as foster development of electronic commerce through use of electronic signatures.


The said Bill further provides that Electronic communication, electronic signature, electronic evidence, electronic contracts cannot be denied legal effect on the ground that is in electronic format.


Furthermore, electronic records should be retained in the format in which it was generated, received, documents is signed through secure electronic signature.


So far, the Ministry through Legal Section and ICT department officers have been to the state media with the intention to keep the nation informed and educated about this forthcoming legislation.
